LOW-COST DIVORCE
Sometimes spouses are able to agree on the terms of their divorce. If you believe that you and your spouse have agreed on the issues look through this checklist. If you can agree with all of the statements, then you probably qualify for the LOW-COST DIVORCE.
CHECKLIST
- My spouse and I have a few assets.
- If we have retirement accounts, we have agreed that we will each keep our own retirement accounts.
- We have agreed on a division of the bank accounts, including checking and savings accounts.
- If we have minor children I believe we are likely to agree on custody, a visitation schedule, the amount of child support and health insurance.
- Either my spouse or I have lived in Texas for the previous 6 months and in the county for the previous 90 days.
- My spouse is willing to cooperate with the divorce.
- My case does not involve family violence, child abuse, substance abuse, alcohol abuse or criminal activity. If these issues have been present in the past my spouse and I wish to set these matters aside and proceed with an amicable, uncontested divorce.

The cost of an uncontested divorce is a Flat Fee of $1500.00 plus the filing fee. Any consultation fee that you pay for an office consultation will be applied to the Flat Fee. Ms. Lambeth will prepare the petition for divorce, waiver of citation and final decree of divorce based upon information you provide. Ms. Lambeth will also represent you before the judge to make certain that your divorce is completed in accordance with Texas laws.
FEES FOR LOW-COST DIVORCE
Items Included in a Flat Fee Arrangement:

Meet with the Client, review the information and factual background applicable to the matter. |

2. |
Prepare an Original Petition and file it with the court. |
|
3. |
Prepare a Waiver of Citation assuming the client is able to have the respondent sign the waiver. |
|
4. |
Meet with the client and the opposing side to consummate an Agreed Divorce Decree, including up to 2 revisions, but not to exceed two hours. All revisions and meetings thereafter are charged on an hourly basis. |

5. |
Attend one uncontested hearing to finalize the divorce. |
|
6. |
Payment of Filing Fee |
|
7. |
Completion of State of Texas Vital Statistics form. |
|
8. |
Preparation of Employer's Wage Withholding Order and filing the order to open your Texas child support account. |
|
9. |
Preparation of documents to transfer motor vehicles. |
|
10. |
Referrals to mental health care advisors and divorce support groups. |
|
11. |
General help in navigating the emotional waters of a divorce. |
Items Not Included In a Flat Fee:

1. |
Outside fees associated with obtaining service on the respondent. These are fees charged by independent providers and can range from $60 - $200. |

2. |
If the divorce becomes a contested matter, in any way, all matters dealing with temporary support, temporary injunctions, etc., shall be handled on a hourly basis. |
|
3. |
If the client makes in excess of two revisions or changes to the divorce decree. |
|
4. |
Any and all discovery work including but not limited to, depositions, legal research, interrogatories, motions to produce, request for admissions, etc. |
|
5. |
Any post-judgment pleadings that may be required or requested. |
|
6. |
Any and all review analysis that may be required in order for one spouse to obtain pension rights, benefits, or moneys from the other spouse. |
|
7. |
Any and all legal research, advise or work that may be required as a result of tax considerations. |
|
8. |
Settlement negotiations other than the one referred to in the flat fee arrangement above. |
|
9. |
Any attorney ad litem or guardian ad litem fees. |
|
10. |
Drafting of real estate documents or documents necessary for the legal transfer of retirement accounts. |
